Terms of Use

1. Agreement

These terms are an agreement between you and TalkStash ("we", "us") for the TalkStash app and related services. The service provider is TalkStash. Contact: contact@talkstash.com. By signing in and using TalkStash you agree to these terms and to our Privacy Policy. If you do not agree, do not use TalkStash.

2. Who can use TalkStash

• You must be at least 13 years old. If you are under the age of majority where you live, you need a parent or guardian's permission.
• You sign in with Apple or Google. You are responsible for activity on your account and for keeping your sign-in secure.

3. What TalkStash does

TalkStash is a language-learning app. You chat with Mira, an AI assistant, and can save useful parts of a conversation as notes and flashcards, then review them. Mira is an AI, not a person.

• AI replies can be wrong, incomplete or out of date. Check anything important before you rely on it.
• TalkStash is not professional, legal, medical or financial advice.
• Please do not share sensitive information in your chats.

4. Your content

You keep ownership of what you write and save in TalkStash. You give us permission to store, process and display it to provide the service to you. This includes sending your messages and related context to third-party AI providers to generate replies; see Third-party AI providers. You are responsible for your content and must have the right to use it.

5. Acceptable use

Do not use TalkStash to:

• break the law or infringe someone else's rights;
• create or share content that is harmful, abusive, hateful, sexually exploitative of minors, or promotes self-harm or violence;
• try to bypass usage limits, safety checks or access controls, or probe, scrape or overload the service;
• resell or share your account, or use automated means to access the service.

AI requests may be blocked or paused if our safety checks flag them. Repeated blocked requests can lead to a temporary pause on AI features for your account.

Some read-aloud voices are AI models you download to your device. Supertonic 3 is provided under the BigScience OpenRAIL-M licence, and by using it you agree not to use it or its output to break the law; harm minors; spread false information or personal data meant to harm others; present its audio without making clear that it is machine-generated; defame or harass anyone; impersonate someone without their consent, including through deepfakes; make fully automated decisions that harm someone's legal rights; discriminate against people or exploit their vulnerabilities; give medical advice; or support law enforcement, justice, immigration or asylum decisions. 6. Subscriptions and usage limits

• TalkStash has a free plan and two paid plans, TalkStash Pro and TalkStash Premium. There is no free trial. The price shown in the App Store when you buy is the one that applies, and it may differ by country or include tax.
• Paid plans are sold through the Apple App Store, billed to your Apple account and renew automatically each month or each year, depending on the plan you choose, unless you cancel at least 24 hours before the end of the current period.
• You manage or cancel a subscription in your Apple ID settings. Deleting your TalkStash account does not cancel a store subscription.
• Payments and refunds are handled by Apple under its own terms. We cannot issue refunds for purchases made through the App Store.
• Each plan includes an AI usage allowance and limits on how much you can store. We may adjust plans, prices and limits; we will tell you in the app before a change affects an active subscription period.

7. Your account and deleting it

You can delete your account and data at any time in the app under Profile → Account → Delete Account & Data. See the Privacy Policy for what is deleted and what is kept. We may suspend or end an account that breaks these terms or puts the service or other users at risk.

8. Changes

We may update the service and these terms. When the terms change in a way that matters, we will tell you in the app or by updating the date above. Using TalkStash after a change means you accept the new terms.

9. Disclaimers

TalkStash is provided "as is" and "as available". We do not promise that the service will be uninterrupted or error-free, or that AI output will be accurate. Some places do not allow these disclaimers, so they may not fully apply to you.

10. Limit of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential damages, or for loss of data, profits or goodwill. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or US$50. Nothing in these terms limits liability that cannot be limited by law.

11. Governing law

The law that applies to these terms is decided by the applicable legal rules. Before bringing a claim, please contact us at contact@talkstash.com so we can try to resolve it informally. If that does not work, you may bring a claim before a court or dispute resolution body that has jurisdiction under the law. Nothing in these terms takes away protections that the consumer laws of the place where you live give you.

12. Apple App Store

If you downloaded TalkStash from the Apple App Store, your licence to use the app is also governed by Apple's standard Licensed Application End User License Agreement. These terms cover your use of the TalkStash service. These terms are between you and us, not Apple.
